PDRM INVESTIGATES SUARAM UNDER THE PEACEFUL ASSEMBLY ACT 2012
ASP Ravintharan a/l Selvarajah (G/12731) together with Sarjan Venktasalam a/l Ponusamy (RF/74677) arrived at SUARAM office at or about 12:20PM earlier today. The officers have requested for SUARAM’s co-operation in an investigation based on police report no. B RPT14699/2012lodged by officers from the police and Companies Commission of Malaysia (“CCM”).
According to ASP Ravintharan, the Investigating Officer for the investigation, statements under S112 of the Criminal Procedure Code will be recorded from the following individuals: Nalini Elumalai,Cynthia Gabriel, Fadiah Nadwa Fikri, Wong Kar Fai, Lembah Pantai MP Nurul Izzah, Arumugam, Sivaranjani, Sarah Devaraj, Ivy Josiah and Auntie BERSIH.
According to ASP Ravintharan ,
“…if you assemble without notice under S9(5), more than 3 persons it’s wrongful assembly… saman sepuluh ribu… the AG is interested… it’s the APA act(meant to be Peaceful Assembly Act 2012)…we have the power to take any investigation anywhere, no need to come to the police station…”
The Royal Malaysian Police (“PDRM”) will investigate the abovenamed individuals under the Peaceful Assembly Act 2012 for allegedly assembled unlawfully at the CCM office on 18/9/2012. It is now PDRM’s turn to harass SUARAM.
Thus far, the CCM has concluded its investigation while the Registrar of Society (“RoS”) is still investigating SUARAM. In fact, SUARAM staff has appeared at the RoS headquarters at Putrajaya on 19/11/2012 and 28/11/2012. Lawyers Amer Hamzah Arshad and Fadiah Nadwa Fikri have also been served notices pursuant to S66 of the Societies Act 1966 by the RoS on 29/11/2012 to assist in the investigation on SUARAM.
SUARAM reiterates that the on-going harassment against SUARAM is highly political and demands that all form of intimidation and harassment against human rights defenders be stopped immediately.
