Suara Rakyat Malaysia (SUARAM) welcomes the decision by the Attorney General to adhere to the findings of the High Court on the issue of Section 13 of the Security Offences (Special Measures) Act 2012 (SOSMA).
The decision by the Attorney General marks a turning point where the oppressive provisions of SOSMA are dismantled with the power and authority to grant bail returned to the judiciary. This would ensure that detainees who were previously denied any opportunity to plead their case for bail will now have an option to post bail.
The recent developments in the courts and the Attorney General’s Chambers on SOSMA vindicates the long years of activism and campaigns by civil society and politicians against draconian and unconstitutional legal provisions within our laws. Malaysia is now one step closer to the abolition of draconian laws that allow permit detention without trial.
With this, Malaysia is also one step closer to a reformed and revitalized judiciary which is empowered to serve as a guardian of our fundamental liberties and a check on the executive.
