Tolak Kapal Pelarian Tindakan Tidak Berperikemanuasiaan

Suara Rakyat Malaysia (SUARAM) mengutuk tindakan kerajaan Malaysia yang menolak kemasukan bot mangsa-mangsa pelarian etnik Rohinya dan menolak mereka semula ke laut pada 16 April lalu. Pada hari sebelumnya, dilaporkan bahawa pengawal laut Bangladesh telah menyelamatkan sebuah bot yang mengandungi kira-kira 382 orang pelarian yang tersiri daripada wanita dan kanak-kanak setelah lebih dua bulan terdampar selepas ditidakkan memasuki Malaysia . Lebih 30 orang dilaporkan meinggal dunia sebelum bantuan sampai. Walaupun Malaysia bukan negara penandatangan Konvensyen Pelarian Bangsa-Bangsa Bersatu (PBB) 1951 yang mengiktiraf hak-hak seserang sebagai pelarian, SUARAM berpendapat bahawa Malaysia masih lagi mempunyai tanggungjawab terhadap kemanusian secara sejagat.

Pihak tentera menyatakan tindakan tersebut adalah bagi mengelakkan kemasukan wabak COVID-19 ke dalam negara . Dengan prosedur saringan dan pengasingan sosial, mereka masih dapat tetap diselamatkan tanpa perlu menjejaskan kesihatan awam rakyat Malaysia. Sebagai contoh, Cuba telah memebenarkan dua buah kapal dermaga yang membawa penumpang positif COVID-19 untuk berlabuh di perairan mereka bagi mendapatkan bantuan kesihatan, kerana mereka berpendapat bahawa hak kepada perkhidmatan adalah hak asasi semua. Tindakan Malaysia yang membahayakan nyawa 200 penumpang dengan menolak bot-bot ini kembali ke laut jelas tanpa sebab yang munasabah merupakan satu tindakan yang tidak berperikamanusiaan.

Kami bersetuju bahawa masalah konflik ketenteraan, kewarganegaraan dan status etnik Rohinya dan mana-mana entnik minoriti di lain ASEAN merupakan tanggungjawab bersama dan perlu penelitian dan Kerjasama daripada negara-negara ASEAN lain. Namun, Malaysia sepatutnya menjadi contoh yang lebih progresif bagi negara-negara ASEAN dalam meneggakkan hak asasi manusia dalam rantau ini.

SUARAM juga ingin mengingatkan bahawa pelarian-pelarian di yang tinggal Malaysia, walaupun diiktiraf oleh sebagai pemegang kad Pesuruhjaya Tinngi Pelarian PBB (UNHCR), namun tidak diktiraf oleh kerajaan Malaysia. Mereka tidak mempunyai hak untuk bekerja, mendapat Pendidikan formal dan akses kepada servis kesihatan awam. Dengan kekangan yang dihadapi mereka masih perlu menyara kehidupan dan keluarga, seringkali menyebabkan menghadapi masalah dengan pihak berkuasa, menambah kesulitan kepada kehidupan harian mereka.

Pusat-pusat bantuan komuniti seperti makanan, sekolah, kesihatan kemudahan lain disediakan di atas inisiatif pihak bukan kerajaan NGO setempat, nasional dan antarabangsa. Perintah Kawalan Pergerakan (PKP) berikutan penularan COVID-19 membuatkan kumpulan-kumpualan ini lebih penting bagi memastikan kelangsungan hidup komuniti pelarian kerana kerajaan tidak menyalurkan apa-apa bantuan.

Pelarian bukanlah penerima faedah dan mereka yang memperolehi keistimewaan daripada kerajaan, tapi merupakan mangsa yang tersepit di tengah-tengah keadaan yang berada di luar kawalan mereka. SUARAM menyeru agar kerajaan mengutamakan kemanusiaan dan empati terhadap golongan yang lari dari kekejaman dan kesengsaraan.


Turning Away Refugee Ships an Inhumane Act.

Suara Rakyat Malaysia (SUARAM) condemns the government’s act of denying entry to the boats of Rohingya refugees and turning them back to sea on the 16th of April. Just the day before, it was reported that the Bangladeshi maritime authorities has rescued a boat with 382 refugees aboard, consisting of women and children, after being stranded for more than 2 months due to the denial of entry into Malaysia. There were more than 30 deaths onboard before help arrived. Even though Malaysia is not a signatory to the 1951 Refugee Convention relating to the Status of Refugees recognising the rights of a refugee, SUARAM is of the opinion that Malaysia has a universal humanitarian obligation towards these people.

The military states that said action was to prevent imported cases of the COVID-19 disease. However, with screening procedures and social distancing, they can still be saved without jeopardising Malaysia’s public health. For example, Cuba has allowed two ships carrying COVID-19 positive passengers to dock in their waters to receive medical assistance, reasoning that health is a human right. Malaysia’s act of turning those boats back to sea without good cause endangering the lives of the 200 passengers aboard is inhumane in the extreme.

We agree that problems arising from military conflicts, nationality and the status of ethnic Rohingyas or any other ethnic minority in ASEAN are a collective responsibility requiring the cooperation of other ASEAN nations. Regardless, Malaysia should have set a progressive example for other ASEAN nations in defending basic human rights in the region.

SUARAM would like to remind that refugees residing in Malaysia, despite having recognition by virtue of being a UNHCR refugee card holder, are still not recognised by the Malaysian government. They do not enjoy rights to work, receive formal education, nor ready access to public healthcare services. Despite these constraints, they still need to sustain themselves and their families, often leading to problems with the authorities. This further complicates their daily lives.

Community welfare centres such as soup kitchens, schools, healthcare facilities have been prepared under local, national, and international non-governmental organisation (NGO) initiatives. These play a crucial role in protecting the welfare of refugee communities under the Movement Control Order (MCO) following the spread of COVID-19 as the government has not extended any form of assistance.

Refugees are not recipients of benefits or favours from the government, but are instead victims caught in a situation beyond their control. SUARAM urges the government to prioritise humane treatment and empathy towards those who escape from cruelty and suffering.

For years, I have lodged numerous police reports & even written complaints to the AG’s Chambers & the DPPs pertaining to the deliberate crimes committed upon myself such as the thefts of my light green folder containing my academic credentials & professional documents etc. and light blue professional diary and its contents in 2010 etc. A decade has passed & the principal offenders, abettors & co-conspirators have not been charged & punished.
