The OpsScorpene Case in Paris – At a Cross Road.

SUARAM took a bold step in 2009 to pursue the corruption case involving the purchase of two SCORPENE submarines by the Malaysian Ministry of Defence from the French supplier, DCNS.

The decision to lodge a corruption complaint in the French court was because SUARAM faced brickwall after brickwall from the Malaysian authorities.

From the complaint lodge and after almost two years of initial investigations, the French authorities found enough evidence to appoint two judges to lead a court inquiry as per the French Judicial System.

Malaysians were filled with excitement, hope and encouragement that the truth may finally be revealed, even though if it is through an overseas court.

The first two fund raising dinners organized to raise funds to pay for the case  was greatly  supported by the public as Malaysians adopted the case as a People’s Initiative to fight against corruption.

As expected, the legal journey is a long and slow process and meanwhile the EURO 3,000 a month retainer fee for our French legal team needs to be paid.  The Malaysian OpsScorpene Team  serves pro-bono and often times having to face harassment and intimidation from the authorities.

The dwindling funds left the OpsScorpene Team with little choice but to organize yet another fund raising dinner scheduled for Friday 19th July 2013.

Sadly, the public response and support this time round is all but luke-warm. With under 10 days to go, less than 50% of the targeted tables have been purchased.

The Fund Raising dinner will definitely go on as scheduled, the OpsScorpene Case is now at a difficult cross road.

Although there have been slow but positive developments on the French side, the OpsScorpene Team is unable to reveal too much at any point in time as it may derail the court process. However, the Malaysian public is fast losing patience having seen little progress. Thus it is not surprising that there is luke-warm support for the fund raising dinner this time round.

However the truth remains that the empty coffers have resulted in the second quarter French legal  retainer fee being left outstanding. We need funds to continue pursuing the case.

Thus Malaysians will have to decide if indeed we want to continue to unite and pursue Truth and Justice.  It would be a grave disappointment to our future generation if this mother of all corruption case is to be dropped at this point.

The French courts have received great cooperation from the Hong Kong authorities in revealing the movements of illicit funds. Many names of individuals and companies have surfaced linking to politicians and political parties.

Do we drop this case now because of lack of funds; what path do we take now?

The ball is in the court of the Malaysian public.

Ops Scorpene: French Inquiry Makes Headway

OPS SCORPENE: FRENCH INQUIRY MAKES HEADWAY

 

On 19 April 2013, 2 SUARAM secretariat, and key spokespersons of the Ops Scorpene campaign, Ms Cynthia Gabriel and Ms Fadiah Nadwa, went on an urgent mission to PARIS at the request of SUARAM’s French lawyers, William Bourdon and Apoline Cagnat.

 

The two judges in charge of the case Roger LeLoire and Serge Tournaire, have been following recent new information offered by various persons on the death of Altantuya Shaaribuu.

 

The brief mission discussed the following details:

 

  1. Important revelations on the deepening role of Najib Razak in the SCORPENE Scandal and the brutal murder of Altantuya Shaaribuu.
  2. New and damning revelations surrounding the SD1 and SD2, the testimonies of the late PI Bala shortly before his death, on Najib’s and his family members direct hand in the controversy and the further revelation of lawyer Americk Sidhu at the Malaysian BAR AGM 16th March 2013.
  3. The lead judge in the ongoing inquiry Roger Le Loire has requested further information on how the recent testimonies will impact upon the ongoing investigations. The French courts have now extended its investigations into circumstances that led to her death, and especially if Najib had abused his powers as then Deputy Prime Minister to cover the truth behind the brutal death of Altantuya.
  4. Ongoing investigations some of which are completely confidential and are awaiting the green light from the judge before it gets to the public domain hopefully in the coming days.

 

Outcomes

 

  1. Our lawyers have submitted to the judge, the latest developments, suggesting strong elements of acts of criminality under the Penal Code including criminal intimidation and obstruction of justice by Najib in instructing for the SD2 to be formulated, for the fabrication of lies and untruths without the consent of PI Bala.

 

  1. 2 new witnesses will be subpoenaed urgently. The first is senior lawyer Americk Sidhu (PI Bala’s lawyer) followed by Cecil Abraham. We note that the Bar Council has just a few days ago reported that they have referred Cecil Abraham to the Advocates & Solicitors Disciplinary Board  for misconduct.
  2. At least two other fresh exposes will be made in the coming weeks, pending approval from the judge.

 

BACKGROUND

 

French prosecutors found prima facie evidence to investigate alleged improprieties against French naval shipbuilder DCNS over its sale of two Scorpene submarines to the Malaysia in 2002. Judges Roger Le Loire and Serge Tournaire  – have been entrusted to oversee the case at the Paris Tribunal de Grande Instance.

 

SUARAM has been made a civil party to the ongoing inquiry, which commenced on 16 March 2012.  The two judges are designated to investigate the (alleged) misuse and mismanagement of funds amounting to more than 114.9 million Euros or RM 540 million ringgit.

 

 

 

We thank our lawyers and judge Le Loire for their diligence in pushing open the ongoing inquiry onto new levels, where the investigations will now focus on Najib as a key personality in trying to cover up the death of Altantuya Shaaribuu, and his deepening role in the Scorpene Scandal.

FRENCH LAWYERS CALLS FOR SUARAM FOR URGENT MEETING
SUARAM would like to inform the media that our lawyers in France, William Bourdon and Apoline Cagnat have called us for an urgent meeting following recent developments on the SCORPENE Scandal, that could have severe implications on the French inquiry.
This morning 2 SUARAM Secretariat and key spokespersons of the SCORPENE campaign, Ms Fadiah Nadwa Fikri and Ms Cynthia Gabriel, have left for France on an urgent mission.
They are expected to update and make submissions before judge Roger Le Loire, following discussions with the lawyers.
The duos are expected to hold a press conference on 22 April 2013.
